Terms of Service

Effective Date: [Insert Date]. By creating an account, requesting a delivery or otherwise using BuruExpress, you agree to be bound by the Terms of Service set out below.

1. The BuruExpress Service

BuruExpress is an on-demand, hyperlocal parcel delivery platform operating within Abuja, Federal Capital Territory, Nigeria.

Our service is designed for immediate, point-to-point movement of a permitted parcel. A User requests collection from a specified location in Abuja, a Rider is assigned where available, and the parcel is transported to the destination confirmed for that request.

BuruExpress is built for direct last-mile delivery. Each booking relates to a specific collection point and a specific destination. The Service does not include storage, overnight storage, inventory management, fulfilment, customs clearance, interstate transportation or hub sorting.

The Service is intended to facilitate a continuous delivery movement from collection to the agreed destination. A Rider is not a custodian of parcels for later collection, later redistribution or indefinite retention.

BuruExpress may refuse, cancel or discontinue a delivery where the request, parcel, route or surrounding circumstances present a legal, safety, security or operational concern.

2. Service Area and Delivery Scope

BuruExpress accepts delivery requests only for collection and delivery locations within its active Abuja service area as shown or confirmed through the Platform.

A delivery must begin and end within the service area available on the Platform at the time of the request. BuruExpress does not undertake cross-border or interstate transportation under these Terms.

Availability is not guaranteed in every part of Abuja at every time. Rider availability, weather, road conditions, traffic, security conditions, government restrictions and other practical circumstances may affect whether a request can be accepted or completed.

3. Who May Use BuruExpress

You may use BuruExpress only if you are legally capable of entering into a binding agreement under applicable law.

If you create an account or place a delivery request, you confirm that:

  • the information you provide is accurate and kept reasonably up to date;
  • you are using the Platform for a lawful purpose;
  • you are the owner of the parcel or have the lawful authority of the owner or other person entitled to send it;
  • you are legally entitled to possess and arrange transportation of the parcel;
  • the parcel may lawfully be transported within Abuja; and
  • the parcel complies with these Terms.

4. Accounts and Access

Some parts of the Platform require an account. You are responsible for keeping your login credentials secure and for activity carried out through your account.

You must notify BuruExpress promptly if you believe your account has been accessed or used without your permission. You must not create or use an account with false, misleading or unauthorised information.

BuruExpress may restrict, suspend or close an account where there is a reasonable basis to believe that the account has been used for fraud, unlawful conduct, abuse of the Service, attempted delivery of prohibited items or conduct that creates a material safety, security or legal risk.

5. Placing a Delivery Request

For each delivery, you must provide accurate information reasonably required to carry out the request, including the collection location, destination, contact details, recipient details, a truthful parcel description and any necessary handling information.

You are responsible for checking the information before confirming the request. A request is not accepted merely because it has been submitted; acceptance remains subject to Rider availability and BuruExpress's operational and safety requirements.

If you provide an incorrect address, inaccurate contact information, a misleading parcel description or incomplete instructions, you bear responsibility for the resulting delay, failed delivery, additional journey or reasonable additional charge.

6. Your Parcel: Ownership, Legality and Packaging

You remain responsible for the parcel until it is lawfully handed over for collection and for ensuring that the information given to BuruExpress about the parcel is correct.

Before collection, you must ensure that you have the legal right to send the parcel; its possession and transportation are lawful; it does not contain any prohibited item; it is securely sealed and packaged; its packaging is suitable for ordinary on-road last-mile transport; and any essential handling requirement has been disclosed before collection.

You must not misdescribe, conceal or disguise the contents of a parcel in order to secure acceptance.

If an item is fragile, breakable, delicate or otherwise susceptible to damage, you must use packaging reasonably capable of protecting it against ordinary vibration, movement and handling during direct road transport. A label or verbal statement that an item is "fragile" does not cure inadequate packaging.

BuruExpress and the Rider do not inspect, test or guarantee the suitability of a User's packaging. Acceptance of a parcel does not amount to confirmation that the parcel has been packed safely or adequately.

Unless expressly agreed by BuruExpress in writing, you should not send an item that requires specialised temperature control, security handling or other conditions beyond ordinary point-to-point parcel transportation.

7. Goods We Will Not Carry

You must not submit a parcel containing any item that BuruExpress is not legally permitted to carry or has determined is unsuitable for the Service, including:

  • Illegal drugs, controlled substances or other unlawful materials, including those regulated by the National Drug Law Enforcement Agency (NDLEA);
  • Cash, banknotes, coins, bearer instruments or similar readily transferable monetary items;
  • Firearms, ammunition, explosives, explosive materials or components, and other dangerous weapons or devices;
  • Flammable, explosive, corrosive, toxic, poisonous, radioactive or otherwise hazardous materials;
  • Stolen goods, counterfeit goods, or any parcel connected with unlawful activity;
  • Glass, ceramics, electronics or other delicate goods with inadequate packaging for ordinary transport;
  • Any item that may endanger the Rider or another person, damage property, or create a material public safety or security concern.

8. Handover, Rider Discretion and Parcel Contents

You must hand the parcel to the Rider in a closed and properly secured condition. Unless a Rider can lawfully observe a parcel's contents without opening it, the Rider is not required to inspect or verify what is inside.

The Rider's collection of a sealed parcel does not confirm its legality, ownership, value, description or condition. You must not ask or pressure a Rider to open a parcel, conceal an item, misstate its contents or participate in conduct that may violate the law.

A Rider may refuse collection or stop participating in a delivery where the parcel, its condition, its packaging or the surrounding circumstances reasonably indicate a safety, security or legal concern.

Where a parcel gives rise to a genuine and reasonable concern that it contains unlawful or dangerous material, BuruExpress may cancel the request and take steps permitted or required by Nigerian law, including providing relevant information to competent authorities where legally required.

9. Delivery and Receipt

You are responsible for ensuring that the recipient's details and destination are correct and that reasonable arrangements have been made for the parcel to be received.

Delivery may be completed when the parcel is handed to the named recipient; a person at the stated destination who reasonably appears authorised to receive it; or another person or location specifically authorised by you through the Platform or another approved BuruExpress communication channel.

If the recipient cannot be reached, refuses the parcel or is unavailable, BuruExpress may contact you for further instructions. Where operationally possible, additional movement may be arranged as a new or amended delivery and may attract an additional charge.

BuruExpress does not keep parcels for later collection. If a delivery cannot be completed, return of the parcel to the original collection point or another immediately agreed lawful location may be arranged, subject to Rider availability and applicable charges.

10. Delivery Changes, Delays and Cancellation

You may request a cancellation or change before completion of a delivery, but BuruExpress cannot guarantee that every request for cancellation or modification can be implemented.

Once a Rider has accepted a parcel and transport has begun, a change of destination may require a new price, operational approval or cancellation of the existing request. Cancellation after a Rider has been assigned or has travelled toward the collection location may result in a charge where this is disclosed through the Platform.

A delivery may be delayed or interrupted by traffic, weather, road conditions, accidents, security events, official restrictions, Rider safety concerns or other circumstances that materially affect safe travel. Any collection or arrival time shown on the Platform is an estimate unless BuruExpress expressly states otherwise.

11. Fees and Payment

The price applicable to a delivery will be displayed or otherwise communicated through the Platform. The final charge may change where the delivery details materially change, including a change in distance, destination, waiting time or another factor disclosed before the relevant charge is applied.

You authorise BuruExpress or its authorised payment provider to process valid charges connected with your use of the Service. Where payment processing is provided by another company, that provider's own terms may also apply to the payment transaction.

You are responsible for ensuring that your chosen payment method is valid and that you are authorised to use it.

12. Lost, Stolen or Damaged Parcels

This section applies specifically to claims concerning loss, theft, disappearance, misdelivery or damage to a parcel during a BuruExpress delivery.

BuruExpress does not insure every parcel as part of the standard delivery fee, and no insurance value should be assumed unless BuruExpress has expressly confirmed separate insurance or declared-value cover in writing.

To the fullest extent permitted by applicable Nigerian law, BuruExpress is not liable for loss, theft, disappearance, misdelivery or damage resulting from inadequate or defective packaging, the parcel's inherent fragility or defect, concealed or inaccurately declared contents, incorrect instructions supplied by the User, delivery to a person accepting the parcel in accordance with your instructions or apparent authority, delay caused by circumstances outside BuruExpress's reasonable control, or the User's breach of these Terms.

Where BuruExpress is directly responsible for a proven loss or physical damage arising from its own failure to exercise the level of care required by applicable law, its liability will be determined in accordance with applicable law and cannot be excluded where exclusion is not legally permitted.

Except where a greater amount is required by mandatory law or expressly agreed in writing by BuruExpress before collection, BuruExpress's aggregate liability for any one delivery shall not exceed the lesser of the amount actually paid for that delivery, or the objectively established direct value of the affected parcel at the time it was handed to the Rider.

BuruExpress will not be liable for indirect or consequential losses, including lost profits, lost business opportunities, loss of anticipated revenue, reputational loss or other purely economic losses.

Nothing in these Terms excludes or restricts any liability that Nigerian law does not permit BuruExpress to exclude or restrict.

13. Claims and Information Required for Review

If you believe a parcel has been lost, stolen, damaged or materially misdelivered during a BuruExpress delivery, you should notify BuruExpress promptly through the official support channel.

To allow a claim to be properly reviewed, BuruExpress may reasonably request information or evidence concerning the delivery reference, parcel contents, nature and extent of the alleged loss or damage, proof of ownership or authority to claim, proof of value, photographs of packaging or damage where available, and other information reasonably necessary to investigate the matter.

Failure to provide reasonably requested information may affect BuruExpress's ability to investigate or verify a claim. A claim must not be understood as an admission of liability merely because BuruExpress receives, acknowledges or investigates it.

14. Your Responsibility for Breaches and Unlawful Parcels

You are responsible for the consequences of submitting a parcel that breaches these Terms or applicable law. Where permitted by law, you will be responsible for BuruExpress's reasonable losses, liabilities, penalties, costs and expenses arising directly from your attempt to send a prohibited item, deliberate concealment or material misdescription of parcel contents, sending a parcel without legal authority, failure to package a parcel adequately where that failure causes or contributes to loss or damage, or other material breach of these Terms.

This does not make you responsible for loss caused solely by BuruExpress where applicable law places responsibility on BuruExpress.

15. Proper Use of the Platform

You must use the Platform honestly, lawfully and only for its intended purpose. You must not create false or fraudulent accounts; impersonate another person; manipulate delivery records, prices or payment processes; interfere with the security or functioning of the Platform; attempt unauthorised access to BuruExpress systems; introduce malicious code or software; use the Platform to facilitate unlawful activity; or misuse information obtained through the Platform.

BuruExpress may investigate suspected misuse and take reasonable protective action, including restricting access or closing an account.

16. Platform Availability

BuruExpress will take reasonable steps to keep the Platform operational but does not promise uninterrupted or error-free access. The Platform may occasionally be unavailable because of maintenance, updates, technical faults, network interruptions, security measures or events outside BuruExpress's reasonable control.

BuruExpress may modify or discontinue a Platform feature where reasonably necessary for legal, security, technical or operational reasons.

17. Intellectual Property

The BuruExpress name, logo, branding, software, interface, content and other materials associated with the Platform are owned by or validly licensed to BuruExpress and are protected by applicable intellectual property laws.

Subject to these Terms, you may use the Platform for its intended personal or legitimate business purposes. You must not copy, reproduce, modify, distribute, commercially exploit or attempt to reverse engineer any part of the Platform except where applicable law expressly permits that activity.

18. Personal Information

BuruExpress processes personal information needed to operate the Platform, provide deliveries, process payments, communicate with Users, protect the Service and meet applicable legal obligations. This may include your name, telephone number, contact details, collection and destination information, recipient details, technical information and records relating to your use of the Service.

Where you provide another person's information, including a recipient's name or telephone number, you confirm that you are authorised to provide that information for the purpose of arranging the delivery.

BuruExpress's handling of personal information is governed by its applicable Privacy Policy and relevant Nigerian data protection requirements.

19. Service Communications

BuruExpress may send you communications reasonably connected with your account or a delivery, including booking confirmations, collection updates, delivery notifications, payment messages and security alerts. You are responsible for keeping the contact information associated with your account accurate.

Where promotional communications require consent or an opt-out mechanism under applicable law, BuruExpress will provide the relevant choices in accordance with those requirements.

20. Third-Party Technology and Payment Services

The Platform may rely on third-party technology, mapping, telecommunications or payment services. A third party may apply its own terms to services it provides directly to you.

BuruExpress is not responsible for a failure of an independent third-party service that is outside BuruExpress's reasonable control, but this does not affect any responsibility that BuruExpress cannot lawfully exclude.

21. Suspension or Closure of Access

BuruExpress may suspend or terminate access to the Platform where there is a reasonable basis to do so, including where you materially breach these Terms; use the Service fraudulently or unlawfully; attempt to send prohibited goods; create a significant safety or security risk; or use the Platform in a manner that may expose BuruExpress, Riders, other Users or the public to material harm.

Where reasonably practicable, BuruExpress may communicate the reason for the action taken. Closing an account does not cancel obligations or liabilities that arose before the account was closed.

22. Changes to These Terms

BuruExpress may update these Terms where reasonably necessary to reflect changes in the Service, law, technology, security requirements or business operations. The current version will be made available through the Platform or another official BuruExpress channel.

Where a change materially affects your rights or obligations, BuruExpress will provide notice or obtain consent where required by applicable law. The revised Terms apply from the effective date stated with the updated version.

23. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. If a dispute arises from the Platform or a BuruExpress delivery, the parties should first make a genuine effort to resolve it through BuruExpress's official support process.

If the dispute is not resolved, either party may refer the matter to a court of competent jurisdiction in Nigeria, subject to any mandatory legal requirements that apply. Nothing in this section prevents either party from seeking urgent relief where immediate court intervention is legally justified.

24. Other Legal Terms

These Terms, together with any policy or additional terms expressly incorporated into them, form the agreement between you and BuruExpress concerning your use of the Platform and the Service.

If any provision is held to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A delay or failure by BuruExpress to enforce a provision does not mean that BuruExpress has permanently given up the right to enforce it later.

You may not transfer your rights or obligations under these Terms without BuruExpress's prior written approval. BuruExpress may transfer its rights or obligations as part of a legitimate corporate restructuring, financing, merger, acquisition or transfer of relevant business assets, subject to applicable law.

25. Contacting BuruExpress

Questions, complaints and requests relating to these Terms or the Service should be sent through BuruExpress's official support channels available on the Platform.

26. Acceptance of These Terms

By creating a BuruExpress account, requesting a delivery or using the Platform, you confirm that you have read these Terms and agree to be bound by them.

You specifically acknowledge that BuruExpress provides an on-demand, direct, point-to-point parcel delivery service within Abuja. The Service is not a storage or distribution service, and a Rider is engaged to move an accepted parcel for the specific delivery requested.

You are responsible for ensuring that every parcel you submit is lawfully possessed, lawfully transportable, accurately described and properly packaged. You also accept the limitations and conditions concerning prohibited items, delivery completion and liability set out in these Terms.
